 Williamson County Constables

Constables are law enforcement officials elected for each precinct of the County. Williamson County Constables are licensed Texas Peace Officers who execute court orders from county and state courts. Most often this includes criminal arrest warrants, protective orders, property seizures, evictions, mental health commitments, and other writs. Duties of Constables

Among other duties, Constables perform the following

  • execute and return all processes, warrants, and precepts directed and delivered by any lawful official

  • seize and sell real and personal property upon lawful order of a court, returning the proceeds according to law

  • enforce all state and penal laws, arresting offenders anywhere in the state with lawful warrant, or without warrant for felonies committed in this county and all adjacent counties

  • serve as the Chief Law Enforcement Officer of the Justice Court

In the course of providing these services, particularly in the service of court papers, every paper with erroneous or outdated information is researched, free of charge, to provide the most current location or other pertinent information.

The office of Constable is one of the oldest law enforcement positions in history, dating back to the Roman Empire and mentioned in the Magna Carta. In Texas, the office of Constable has existed since 1823 when Stephen F. Austin himself formed the first group to keep the peace.

The present office of Constable is established by Section 18, Article V of the Texas Constitution which prescribes the election of one Constable to a four year term for every precinct in each county. Article 2.12 of the Texas Code of Criminal Procedure designates the Constable and Deputy Constable as "Peace Officers" to have the responsibilities and requirements of all other law enforcement positions.

County commission is based on percentage of monies collected:
10% of first $10,000
5% of next $15,000
2.5% of amounts more than $25,000

Any Writ (unless otherwise specified), Venditioni Exponas, Order of Sale and Mental/Alcohol/Drug Commitment served which exceeds 2 hours, and additional fee of $30.00/hour per officer plus IRS recommended mileage required for an officer to perform service and return from performing the service.

If ordered by the court to transport to court of Jurisdiction a fee of $30.00/hour per officer plus IRS recommended mileage/mile, plus overnight lodging cost if necessary.

Make checks payable to Williamson County Constable's, and mail directly to the Constable providing delivery of process.
